These are the terms and conditions of the Continuing Professional Development website (the “Site”), (At times “Continuing Professional Development” may be referred to as, “we”, “us”, “our” and terms of similar meaning).
These terms and conditions govern your use of our Site; by using our Site, you accept these terms and conditions in full. If you disagree with any part of these terms and conditions, please do not use our Site.

Unless otherwise stated, we or our licensors own the intellectual property rights in the Site and material on the Site. Subject to the licence below, all these intellectual property rights are reserved.

You may view, download for caching purposes only, and print pages from the Site for your own personal use, subject to the restrictions below.

While we endeavour to ensure that the information on this Site is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the Site remains available 24 hours a day 7 days a week or that the material on the Site is kept up-to-date.
To the maximum extent permitted by applicable law we exclude all representations, warranties and conditions (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill).
Our liability is limited to the purchase price on any product purchased from Continuing Professional Development. We will not be liable for any direct or indirect loss or damage arising under these terms and conditions or in connection with our Site, whether arising in tort, contract, or otherwise. We will not be liable for any loss of profit, contracts, business, goodwill, data, income, revenue or anticipated savings arising under terms and conditions or in connection with our Site, whether direct or indirect, and whether arising in tort, contract, or otherwise.
(1) Receiving of Payments
All payments are a transaction between the purchaser and the provider (PayPal). Continuing Professional Development is not responsible for this transaction and any problems or claims are between the purchaser and the provider.
(2) Restricted access
Access to certain areas of our Site is restricted. We reserve the right to restrict access to other areas of our Site, or indeed our whole Site, at our discretion.
If we provide you with a user ID and password to enable you to access restricted areas of our Site or other content or services, you must ensure that that user ID and password is kept confidential. You accept responsibility for all activities that occur under your user ID or password.
We may disable your user ID and password at our sole discretion OR if you breach any of the policies or terms governing your use of our Site or any other contractual obligation you owe to us.
(3) Use of our site - Bulletin board / chat room / comments /forum
You must not use our Site in any way that causes, or may cause, damage to the Site or impairment of the availability or accessibility of the Site.
You must not use our Site in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
You must not use our Site for any purposes related to marketing
You must not use our Site to copy, publish or send mass mailings or spam.
You must not use our Site to copy, publish or send material which is illegal or unlawful, or material which could give rise to legal action under New Zealand and other applicable law. All material you copy, publish or send via our Site must not be defamatory, obscene, indecent, hateful, discriminatory or inflammatory; such material must not infringe any person’s intellectual property rights or rights of confidence, impinge upon any person’s privacy, or constitute incitement to commit a crime; further, material must not be misleading, deceptive, sexually explicit, threatening, abusive, harassing or menacing.
We reserve the right to edit or remove any material posted upon our Site.
We may take such action as we deem appropriate to deal with the posting of unsuitable material, including suspending or cancelling your account, restricting your access to our Site, or commencing legal proceedings against you.

These terms and conditions will be governed by and construed in accordance with New Zealand law, and any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of New Zealand. From Visitors we collect the e-mail addresses of those who communicate with us via e-mail, aggregate information on what pages Visitors access or visit, and information volunteered by the Visitor.
From Course Purchasers, we collect name and email information. We do not collect or hold any billing addresses or credit card information.
(3) How we use your information.
We store and use personal information for many purposes. The information we collect is used to improve the content of our Site and the quality of our service, and is not shared with or sold to other organizations for commercial purposes, except to provide products or services you’ve requested, when we have your permission, or under the following circumstances:
It is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by law.
When you join or interact in any way with, but not limited to, bulletin boards, chat rooms, forums or leave comments on our site for any reason. You also agree not to disclose other contributors’ information to any third party.
We may use your email address without further consent for marketing or administrative purposes (such as notifying you of major system updates, customer service needs, new courses or items for which you have requested communication).

Continuing Professional Development uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run Continuing Professional Development.
Continuing Professional Development strives to protect your personal information. No data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot warrant the security of any information you transmit to us.
